The Problem
My Mother, Edna Miller on behalf of her son Justin Chase Miller, a resident of California, a citizen of the United States and a recent amputee due to a traumatic accident involving Yamaha Rhino Side by Side All Terrain Vehicle (ATV), which is alleged to have severe design defects in that the ATV’s center of gravity is too high, it is too top heavy and the tires are too small resulting in a high rollover risk even at low speeds; exercises their constitutional rights to petition to the Executive Branch, the Legislative Branch, the Judicial Branch, all or any elected officials of the government calling for expansion and creation of legislation retaining to current design and safety requirements for manufacturer’s of ATV’s (Yamaha Rhino). We ask that you companion the requested legislation and intervene with elected State Representatives to:
Recognize that the current product liability, safety standards, and product design regulation and/or laws pertaining the manufacture and sale of All Terrain Vehicles (YAMAHA RHINO) do not adequately protect and address issues of safety for consumers. Furthermore, we request a formal investigation of current design testing among manufacturer’s All Terrain Vehicles (YAMAHA RHINO)
We ask you, California State Assembly, to work on our behalf to alert legislature that people in our great State of California and across the United States are expressing demands for changes in the current law.
The formulation of new legislation will ultimately give injured individuals and deceased love ones an equal platform with product manufacturers.
Our immediate goal is to inform negligent manufactures through the creation of sound legislation that the voices of voting citizens and the outrage of injured victims are louder than the voices of only a few capitalist.
Plan of Action
A new law under the J Chase Law shall require manufacturers, retailers, wholesalers and outlet distributors which distribute and/or sale All Terrain Vehicles (Yamaha Rhino) to inform consumer’s of all additional safety equipment necessary for optimum safety and to provide hands on safety trainings for consumers at the time of purchase. A certificate of completion of safety instructions shall be issued to the purchased owner prior to possession and or ownership of all terrain vehicles.
Despite the fact that there are a large number of products liabilities, personal injury and wrongful death lawsuits filed in all 50 States against the manufacturer, Yamaha has yet to issue a formal recall of the defective Rhino ATV. Though it has issued a limited letter to install the needed safety doors at no cost to the ATV owners, to date Yamaha is still advertising the product without a hazardous safety warning or any requirement to provide potential consumer’s with any certified safety training.
The J. Chase Law shall further require manufacturer’s to provide a safety video with All Terrain Vehicles (Yamaha Rhino) retailers, wholesalers and outlet distributors when sold.
According to the U.S. Consumer Product Safety Handbook, visual aids increases the percentage of manufacturer recommend use of products; therefore, increase the safe use of products by consumers. U.S Consumer Product Safety Commission (CPSC) studies indicate that inexperienced drivers face higher risk of injury according to recreational data collected by CPSC. A safety video will increase consumer’s knowledge.
